Are referral fees legal between real estate agents in Australia?

Yes, between licensed agents. Most states require the referring agent to hold a valid real estate licence. The referral fee must be paid to the licensed agency (not directly to an unlicensed salesperson). Unlicensed introducers can refer leads but cannot legally take commission shares in most jurisdictions - they take a flat introducer fee from the buyer or vendor instead.

What is a conjunctional commission in real estate?

Conjunctional commission is the split of commission between two agencies that both worked on the same sale - one held the listing, the other introduced the buyer. The standard split is 50/50 unless the listing agreement specifies otherwise. The selling agency invoices the vendor for the full commission and pays the conjunctional share to the introducing agency.

How much commission do real estate agents charge in Australia?
